Is a contract set in stone? That remains to be seen.

CONTRACT LAW

Real estate practice has shown that a well-thought-out contract can prevent a great deal of disputes. Such disputes might relate to a contract of sale, an agreement commission contract with an estate agent or a building contract. Specific contracts require specific knowledge of the law and developments on the market. The lawyers of Amstel Advocaten have the required knowledge to answer questions such as: How should I deal with the unreasonable general terms and conditions of a supplier or client? Can I word the general terms and conditions to exclude any damage that might occur? Do I have a ‘watertight’ contract? Have I included everything in the contract, or have I overlooked something?

Amstel can help you draw up watertight contracts in the field of real estate law as well as draw up and verify other documents which require a certain degree of expertise. The following are a number of examples:

  • agreements in the widest sense (lease and purchase agreements and work contracts)
  • general terms and conditions
  • letters of intent
  • guarantee provisions
  • settlement agreements (defects and damage)
  • draft Owners’ Association decisions
  • draft texts to amend deeds of the division
  • loan agreements and sureties
  • user agreements (relating to communal issues dealt within the Owners’ Association)
  • user agreements (relating to immovable property and to prevent a servitude for example)

Although agreements can be drawn up unilaterally, it is also a process in which all the parties can be involved. After all, they all have to sign the agreement in the end. If a contract is drawn up jointly, the parties’ intentions can be laid out in the preamble properly and to the satisfaction of all those involved. In our experience giving advice at the beginning to ensure a well-thought-out and professional contract prevents a great deal of trouble later on. In short, getting legal advice on time could avoid expensive legal proceedings in the future.
